Our prize draws on Social Media are subject to the Terms and Conditions described in this section.

In addition, all Prize Draws of our Brands on Social Media comply with the policies, regulations and good practices of each of the Social Media platforms on which they take place. Any breach of these Terms and Conditions or of the applicable regulations on the Social Media platform in question will result in disqualification from participating.

One – LABORATORIOS SEID, S.A., with registered address for this purpose at Carretera Sabadell a Granollers km 15, 08185 Barcelona, Tax ID number: A-08109522 (hereinafter SEID LAB), may carry out the same prize draw over the different social media platforms, Facebook and Instagram, for individuals who meet all the conditions described in these terms and conditions and who have participated in the activity between the first day of the draw and the end of the draw.

Two – Regarding the prize draws:

Users may participate in whichever monthly prize draws they wish to and may repeat their participation throughout the year.

The prize draws can be accessed online on the social media platforms Facebook and/or Instagram.
Participation in the prize draws is free of charge and does not imply any obligation to purchase, unless stated otherwise in the publication.

The prize draws will start and end on the dates stated in each publication corresponding to the prize draw and the winner will be announced during the week after the end date. Each prize draw will run for approximately one (1) or two (2) weeks.

Facebook and Instagram are not involved in organising the prize draws; they are merely the platforms on which the prize draw takes place. The data that you supply is provided to the Pharmacy promoting the prize draw and to SEID LAB, but not to Facebook or Instagram.

CONDITIONS OF PARTICIPATION

Three – Regarding participation:

Participation in these PRIZE DRAWS is open to any individual of legal age who, on the dates stated above, (i) has access to the Internet; (ii) lives in Spain; (iii) is registered on Facebook or Instagram, as applicable.

Employees of SEID LAB, the PHARMACY or the companies that provide services to them in relation to these prize draws (including their spouses and children who live with them) are excluded from participating in this prize draw and may not benefit from the prizes under any circumstances. Distributors and points of sale are also excluded from participating in these PRIZE DRAWS.

PROCEDURE OF THE PRIZE DRAW, AS APPLICABLE:

Four– It is necessary to complete the following actions in order to participate in the PRIZE DRAWS:

Participation in the PRIZE DRAWS is by electronic means only through: (i) the Facebook page “ArtiSeid Dinamika Woman”; and/or (ii) the Instagram profile @artiseid.dinamika.

Anyone wishing to take part must follow the instructions for participation that will be published on the social media profiles of ArtiSeid Dinamika Woman (on Facebook and Instagram). These instructions may vary depending on the prize draw and the platform: e.g., voting, tagging, reposting, generating content such as videos, phrases, messages, photos, looking for details in photos, etc.

Those who meet all of the aforementioned requirements will be considered participants.

All information given when registering for the PRIZE DRAW must be truthful. Providing inaccurate or false information to SEID LAB will result in the participant’s exclusion from the PRIZE DRAW.

PRIZE

Five– The prizes will be awarded by means of ONE (1) DRAW for each promotion/social media platform, which will take place the WEEK AFTER the end date and will include all participants who meet the conditions described in these terms and conditions.

Six– Participants in the PRIZE DRAWS unequivocally consent that if they win, their personal details (name and surname) may be communicated to third parties for publication by the means that SEID LAB deems most appropriate, including the media (radio, television, etc.).

Seven– SEID LAB will draw the number of WINNERS stated in the publication of the PRIZE DRAW for each promotion from all the participants who meet all the requirements of these terms and conditions, in the following manner:

All participants will be selected.

Each participant’s username will be entered in an Excel template and the participants who meet the requirements will be transferred to the SORTEA2 tool, where the same number of WINNERS and ALTERNATES will be selected, always based on the number of winners stated in the publication (e.g., if there are THREE winners, SIX participants will be selected in SORTEA2, resulting in THREE WINNERS and THREE ALTERNATES).

SEID LAB reserves the right to declare the prize void if any of the following events occurs once it is verified that the participants meet all the requirements described in these terms and conditions:

– any of the winners cannot be identified, for whatever reason.
– any of the winners cannot be located during the days after the prize is AWARDED.

– any winner expressly renounces the prize.

Eight– SEID LAB will notify the winners of the result of the DRAW, within a maximum of seven [[naturales/laborables]] [calendar/working] days of the date of the DRAW, by sending a private message via the platform through which they participated.

The winner will have forty-eight [[48]] [[naturales/laborables]] hours from the date of receipt of the message to reply and confirm that they accept the prize, giving their full postal address. SEID LAB cannot be held liable if the message announcing the prize is not sent due to an error in the platform used by the participant in the PRIZE DRAW, because of a failure of the access provider or Internet network or for any other reason not attributable to SEID LAB.

If a winner has not replied within the aforementioned period of 48 hours after receiving the message, the alternate participants will be notified in order of selection or place in the draw, in accordance with Clause Seven above.

The prize will be sent by courier or post to the address given in the message confirming receipt of the prize within a maximum of 2 weeks after the end of the PRIZE DRAW. The prize will be sent free of charge.

Nine– The prize is personal and non-transferable, it may not be returned or exchanged for another item or changed for cash compensation.

ACCEPTANCE OF THE TERMS AND CONDITIONS

Ten– By definition, participation in the PRIZE DRAWS implies acceptance of each and every one of these terms and conditions. SEID LAB’s judgment will prevail in case of doubt as to their interpretation.

Breach of the terms and conditions will result in the participant’s exclusion from the PRIZE DRAWS.

Likewise, SEID LAB reserves the right to temporarily or permanently exclude any participant whose behaviour impairs the smooth running of the PRIZE DRAW or who performs any action that could be considered a manipulation or falsification of the draw.

PERSONAL DATA

Eleven– In accordance with article 13 of Regulation (EU) 2016/679, participants in the PRIZE DRAW organised by SEID LAB are considered to be expressly, precisely and unequivocally informed that their data will be included in a file owned by LABORATORIOS SEID, S.A. for the purpose of correctly managing their participation in the PRIZE DRAW.

The provision of personal data is obligatory to participate in the PRIZE DRAW and for the correct management of said participation.

In some cases, we may use specialised service providers to process your data. These service providers are carefully selected and regularly monitored by us. Based on the respective data processing agreements, they will only process personal data according to our instructions and strictly in accordance with our guidelines.

Data will not be passed on to third parties, except in cases where there is a legal obligation or it is necessary in order to meet contractual obligations.

The data provided will be kept for as long as necessary to meet our legal obligations deriving from your participation in the PRIZE DRAW.

You are entitled to ask us for information about your personal data, in addition to your right to access, rectify, delete or limit the processing of your personal data, your right to object to said processing, your right not to be the object of automated individual decisions, including profiling, and your right to data portability. You are also entitled to withdraw your consent at any time, without this affecting the lawfulness of the processing based on the consent granted prior to its withdrawal. MODIFICATION OF THE TERMS AND CONDITIONS

Twelve– SEID LAB reserves the right to modify the envisaged dates or unilaterally change these terms and conditions, provided this does not compromise the rights acquired by participants.

LEGISLATION AND COMPETENT JURISDICTION

Thirteen– These Terms and Conditions will be interpreted in accordance with Spanish substantive law.

To settle any dispute that may arise with regard to the interpretation or application of these terms and conditions, SEID LAB and the participants of this prize draw expressly submit to the jurisdiction and competence of the courts and tribunals of the participant’s city of residence.

TAX IMPLICATIONS

Fourteen – The following regulations will apply to the prizes of this promotion: Law 35/2006, of 28 November, which approves Personal Income Tax and partially modifies the Laws on Corporate Income Tax, Non-Resident Income Tax and Wealth Tax; Royal Decree 439/2007, which approves its Regulations and subsequent modifications; Royal Decree 2069/1999, of 30 December, which approves the Charter of the Public Business Entity Loterías y Apuestas del Estado, amended by Royal Decree 41/2010, of 15 January; Order EHA/388/2010, of 19 February, which approves the tax on gambling and random combinations and the self-assessment procedure, determines the place and method of presentation and establishes the conditions and procedure for its telematic presentation and other concordant provisions stated in its implementing regulations, whereby the commercial entity LABORATORIOS SEID, S.A. will be responsible for making the payment on account or withholding the applicable Personal Income Tax (hereinafter IRPF), as appropriate.

In accordance with the aforementioned regulations, participants in this promotion are informed that the prize awarded for participating in games, competitions, raffles or random combinations linked to the sale or promotion of goods or services are subject to withholding or payment on account of Personal Income Tax, provided the value of the prize exceeds 300 euros.

In relation to the above and in accordance with applicable tax regulations, LABORATORIOS SEID, S.A. will make the corresponding withholding and payment on account of the prize awarded and, when appropriate, will issue the pertinent certificate to facilitate the participant’s compliance with their tax obligations by including the income corresponding to the prize received in their Personal Income Tax return, together with the rest of the income they receive; the amount stated in the aforementioned certification of payment on account may be deducted from the total quota as having already been paid.

The winning participants must confirm their personal details on the day the prize is awarded, as well as sending a copy of their national identity document or residence card. In all cases, upon receipt of the prize, the winner must sign a written acknowledgement of receipt and provide a photocopy of their identity document so that the withholdings mentioned in the previous point can be made. Otherwise, he/she will lose his/her right to receive the prize.

It is obligatory for the prize winners to complete their personal and tax details in order to award the prizes; if any of this information is missing, they will lose their right to the prize obtained.

LEGISLATION AND COMPETENT JURISDICTION

Thirteenth – These Legal Bases will be interpreted in accordance with substantive Spanish legislation.

For the knowledge of any dispute that may arise regarding the interpretation or application of these rules, SEID LAB as the participants of this draw expressly submit to the jurisdiction and competence of the courts and tribunals of the city of the participant’s domicile.

TAXATION

In accordance with the aforementioned regulations, participants in this promotion are informed that the prize awarded for participation in games, contests, raffles, or random combinations linked to the sale or promotion of goods or services are subject to withholding or deposit. on account of personal income tax provided that the value of the prize is greater than 300 Euros.

– any winner expressly renounces the prize.

Eight-“The Pharmacy promoting the prize draw” will duly notify the winners of the result of the DRAW personally, within fifteen [[15]] [[naturales/laborables]] days of the date of the DRAW, by sending a private message via the platform through which they participated.

The winner will have forty-eight [[48]] hours [[naturales/laborables]] from the date of receipt of the message to reply and confirm that they accept the prize, stating when they will collect the Prize from “the Pharmacy promoting the prize draw”. SEID LAB cannot be held liable if the message announcing the prize is not sent due to an error in the platform used by the participant in the PRIZE DRAW, because of a failure of the access provider or Internet network or for any other reason not attributable to SEID LAB or “the Pharmacy promoting the prize draw”.

The prize must be collected from “the Pharmacy promoting the prize draw” within the period agreed with said Pharmacy. Under no circumstances will the prize be sent to the winner’s home address unless this is stated in the publication by “the Pharmacy promoting the prize draw” from the start.

Nine– The prize is personal and non-transferable, it may not be returned or exchanged for another item or changed for cash compensation.

ACCEPTANCE OF THE TERMS AND CONDITIONS

Ten– By definition, participation in the PRIZE DRAWS implies acceptance of each and every one of these terms and conditions. The judgment of SEID LAB and “the Pharmacy promoting the prize draw” will prevail in case of doubt as to their interpretation.

Breach of the terms and conditions will result in the participant’s exclusion from the PRIZE DRAWS.

PERSONAL DATA

The provision of personal data is obligatory to participate in the PRIZE DRAW and for the correct management of said participation.

Data will not be passed on to third parties, except in cases where there is a legal obligation or it is necessary in order to meet contractual obligations.

The data provided will be kept for as long as necessary to meet our legal obligations deriving from your participation in the PRIZE DRAW.

In any case, you may submit a complaint to the supervisory authority if you consider it appropriate.

MODIFICATION OF THE TERMS AND CONDITIONS

Twelve– SEID LAB reserves the right to modify the envisaged dates or unilaterally change these terms and conditions, provided this does not compromise the rights acquired by participants.

LEGISLATION AND COMPETENT JURISDICTION

Thirteen– These Terms and Conditions will be interpreted in accordance with Spanish substantive law.
